Am I Too Late? — 12-Year Eligibility Window Check

If you separated from active duty on or after January 1, 2013, there is no time limit to use VR&E — the 12-year rule was eliminated for you by the Isakson-Roe Act of 2021 (38 U.S.C. § 3103(g)). If you separated before that date, your basic eligibility period runs 12 years from the later of your separation from active duty or the date VA first notified you of a service-connected disability rating. A closed window is not always the end. Even after the basic period ends, a Vocational Rehabilitation Counselor (VRC) can still find you eligible if you have a serious employment handicap (SEH), and the clock does not run for any period a medical condition prevented you from participating (38 U.S.C. § 3103(b)–(c)). VA also measures the start of the period from the date you received notice of separation or of your first rating, which can differ slightly from the dates themselves.
