If you separated before January 1, 2013: your basic period of eligibility is 12 years, measured from the later of the date you received notice of your separation from active duty or the date you received your first VA service-connected disability rating. Even if your basic period has ended, you are not automatically out. A Vocational Rehabilitation Counselor can extend eligibility if you have a serious employment handicap, and time when a medical condition prevented you from participating doesn't count against the 12 years (38 U.S.C. § 3103(b)–(c)). A serious employment handicap means your service-connected disability significantly limits your ability to prepare for, obtain, and maintain suitable employment. It is a formal finding made by a Vocational Rehabilitation Counselor (VRC) during your VR&E evaluation — you don't claim it yourself; the counselor determines it from your disabilities, work history, education, and barriers to employment.

An SEH finding matters in two big ways:

• Entitlement at 10%: with a 10% rating, you need an SEH finding to be entitled to VR&E services (at 20%+ an ordinary employment handicap is enough).
• Beating the 12-year clock: for veterans separated before 2013, an SEH finding lets a counselor extend your eligibility beyond the basic 12-year period (38 U.S.C. § 3103(c)).

Yes, with approval from your VR&E counselor. If your circumstances change or you realize a different career path is better suited to your abilities, you can work with your counselor to modify your rehabilitation plan.

Yes. A VR&E counselor's decision is not the final word. In rough order of escalation:

1. Ask for reconsideration — request that your VRC put the denial in writing with the reasons, and ask for a review by the VR&E Officer at your regional office. Many disputes are resolved at this level.
2. Use VA's formal decision review process — Chapter 31 decisions are VA benefits decisions, so you generally have the standard review options: Higher-Level Review, a Supplemental Claim with new evidence, or an appeal to the Board of Veterans' Appeals. Deadlines are generally one year from the decision notice — check your specific decision letter and VA's decision review page for which options apply to your case.
3. Get representation — a Veterans Service Organization can help for free. VA-accredited attorneys and claims agents may charge a fee for appeals (fee agreements are governed by 38 U.S.C. § 5904).
